Player Agreement and Rules of Service

Effective Date: January 1, 2026

1. Acceptance of Terms

This Player Agreement (the "Agreement") constitutes a legally binding contract between you ("the Player" or "You") and Polar Birch Lotto ("the Company," "We," or "Us").

By registering an account, purchasing a ticket, or accessing any part of the website located at polarbirchlotto.com, you explicitly agree to comply with and be bound by these Terms and Conditions, our Privacy Policy, and any applicable lottery rules regulated by Canadian law.

If you do not agree with any part of these terms, you must immediately discontinue use of the Service.

2. Player Eligibility

Participation in Polar Birch Lotto is strictly regulated. To open an account and purchase tickets, you must verify that:

  • Age Requirement: You are at least 19 years of age.
  • Residency: You are a resident of Canada or physically located within an eligible Canadian province at the time of purchase.
  • Legal Capacity: You have the mental capacity to take responsibility for your own actions and can enter into a legally binding agreement.
  • Not Excluded: You are not currently on a self-exclusion list or banned from any gaming operator in Canada.
Warning: Providing false information regarding your age or location is a violation of the law. We reserve the right to report such attempts to relevant authorities and forfeit any winnings obtained by minors or ineligible persons.

3. Account Registration & Security

3.1 Account Creation

You may only hold one (1) account. Multi-accounting is strictly prohibited to prevent fraud and manipulation. During registration, you must provide accurate, current, and complete information (Name, Address, DOB).

3.2 Credentials

You are solely responsible for maintaining the confidentiality of your login email and password. Any activity that occurs under your account is your responsibility. If you suspect unauthorized access, you must notify Support immediately.

3.3 Verification (KYC)

We reserve the right to request proof of identity (e.g., Driver’s License, Passport) and proof of address (e.g., Utility Bill) at any time. Failure to provide documents within 30 days may result in account suspension.

4. Ticket Purchases & Refunds

4.1 Sales Finality

All ticket sales are final. Once a ticket transaction has been confirmed by our servers and a unique Ticket ID has been generated, it cannot be cancelled, modified, or refunded by the player.

4.2 Cut-off Times

Tickets for the weekly Saturday draw must be purchased before 7:55 PM EST on the day of the draw. Transactions processed after this timestamp will automatically be applied to the following week's draw.

4.3 Pricing

Ticket prices are displayed in Canadian Dollars (CAD). We do not charge fees for purchasing tickets, but your financial institution may charge cash advance fees for credit card transactions.

5. Prizes & Claims

5.1 Determining Winners

Winning numbers are drawn using a certified Random Number Generator (RNG) audited by independent third-party testing agencies. In the event of a discrepancy between the numbers displayed on the website and the official game records held by our secure server, the official game records shall prevail.

5.2 Prize Tiers

  • Minor Prizes (Under $1,000): Credited automatically to your Player Wallet within 24 hours of the draw.
  • Major Prizes ($1,000 - $9,999): Require a manual verification process. Funds will be released within 3-5 business days.
  • Jackpots (Division 1): Winners must attend our office (or a designated center) for identity verification. Prizes are paid via bank transfer or cheque.

5.3 Expiration

All prizes must be claimed within 12 months (365 days) from the draw date. Unclaimed prize money will be returned to the prize pool or donated to charity in accordance with regulatory statutes.

6. Responsible Gaming

We are committed to providing a safe environment. We provide several tools to help you manage your play:

  • Deposit Limits: Set a maximum cap on how much you can deposit daily, weekly, or monthly.
  • Time-Out: Take a short break (24 hours to 6 weeks) where access to your account is restricted.
  • Self-Exclusion: A formal request to ban yourself from our services for 6 months, 1 year, or permanently. This cannot be revoked once activated.

7. Prohibited Conduct

You agree not to engage in any of the following activities:

  • Using the Service for any illegal purpose, including money laundering.
  • Attempting to hack, reverse engineer, or disrupt the website's code or servers.
  • Using a VPN or proxy to mask your location for the purpose of purchasing tickets from a restricted jurisdiction.
  • Colluding with other players or using automated bots to purchase tickets.

8. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Polar Birch Lotto makes no warranty that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, Polar Birch Lotto shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the website, including but not limited to loss of data, loss of profits, or technical failures preventing a ticket purchase.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be resolved exclusively in the courts located in Toronto, Ontario.
